MASTERY ONLINE PROGRAM

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK,
AND INDEMNIFICATION AGREEMENT (“AGREEMENT”)

Welcome to Becoming the Light™, a mastery program provided by Devi’s Grace™, LLC, (“Provider”), featuring the spiritual mastery services of Vivianne Nantel (aka “Shree Devi Mayi Ma” also called “Devi Ma”) on an online video provider platform. While this will be a spiritual journey for you, we hope you understand we must address the legal language as directed by our professional counsel, which is a standard and customary procedure. Prior enrolling, please read the following information and release Agreement carefully and indicate Your acceptance of the terms and conditions under which You accept the Program and Services provided.

By clicking the box, you have approved and accepted the  complete agreement.  You agree to be bound by all terms and conditions within this Agreement when enrolling in Becoming The Light™ Mastery Program. Thank you so much.

The undersigned participant (“I”/“Me”/“My”/Myself”), in consideration and as a condition of My participation in Become the Light™ mastery Program, as a precondition of enrollment in a second phase entitled, Radiating The Light™ (aka “Journey No. 6”), and to be permitted to participate in and receive the Program Services in any manner or media, I, my personal representatives, assigns, heirs, and next of kin, (individually and collectively), hereby affirm and agree to the following:

1. I UNDERSTAND that the Program is proprietary in nature and that neither the tools, practices, methods, communications, writings, intellectual property nor otherwise may be shared, disseminated, reproduced, exhibited in any manner or media whether now or hereafter known without the express written consent of Devi’s Grace.

2. I consent and agree to refrain from taking any audio, photographic or video graphic records of My sessions (videos) or the Program, in whole or in part, and that any violation of this Agreement may be cause for termination of the Program and Services and forfeiture of payments received by Devi’s Grace.

3. I understand that I must complete Phase 1 of the Program to proceed to the Phase 2 portion of Program, which will include the audio and/or video recording of the Services including My participation therein, and I hereby grant Provider, its agents, owners, employees, agents and representatives the irrevocable right and a royalty-free license to use, re-use, reproduce, exhibit, display, license, and otherwise exploit the Recording(s),  on a non-exclusive world-wide basis, in perpetuity. This grant of rights includes the use of my likeness, image, photograph, voice, and/or any information and material provided by me in connection with the Recording(s) (collectively, “Materials”) in any and all manner, media, languages, and formats now known or hereafter devised, in whole or in part.  I acknowledge that for all purposes Provider will own the Recording(s) and all Uses of and rights thereto herein granted, and all rights under this Release and Waiver (“Release”), and I have no right to receive any compensation or other consideration for any Use of the Materials or Recording(s). Nothing in this Release obligates Provider to Use the Recording(s), Materials or rights granted in this Release.

4. I UNDERSTAND that the Program, tools, Services, and methods are not a substitute for medical or psychiatric care and Devi’s Grace,  offers no guarantees as to the success or outcome therefrom.  I agree that if necessary I should seek the advice of a qualified health care professional prior to further engaging in yoga, yogic practices such as pranayama (breathing exercises) and/or making any dietary changes as they may be relevant to the Services.

5. I consent and agree to refrain from taking any audio, photographic or video graphic records of My sessions (videos) or the Program, in whole or in part, and that any violation of this Agreement may be cause for termination of the Program and Services and forfeiture of payments received by Devi’s Grace.

6. I ACKNOWLEDGE, agree and represent that I understand the nature and mission of Devi’s Grace, the Program and the Services to be provided, and that I am qualified, in good health and in proper physical, mental and emotional condition to fully participate in the Program without restrictions.  I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately notify the Provider and discontinue further participation in the Program and practices.

7. I FULLY UNDERSTAND that: (a) THE PROGRAM MAY INVOLVE RISKS AND DANGERS WHICH COULD RESULT IN SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“Risks”); (b) these Risks and Dangers to which I will be exposed involve ever changing and unpredictable natural conditions, the condition in which Events take place, My own actions, or inactions, or the NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) there may be other RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to Me or not readily foreseeable at this time; and I CHOOSE TO PROCEED WITH EVENTS AND FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Program and Services.

8. I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Provider, its respective officers, representatives, leaders, organizers, members, volunteers, employees, associates, partners, other participants, and, if applicable, Prashant Dilip Rathod, (each considered on and a party to the “Releases” and Agreement herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS CONNECTED TO MY PARTICIPATION IN MY sessions WITH Provider, THE PROGRAM AND/OR THE SERVICES; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, I or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which I may incur as the result of such claim.

9. I represent and agree that I am over 18 years old, free from any mental or physical health illnesses which would prevent my participation in the Program and Services, and I fully agree to hereby participate in the Program, including the personal empowerment sessions with Provider at My own risk.

10. I agree to, acknowledge and accept full and complete responsibility for the results of the Services and My participation in the Program therein, and to indemnify Provider and the Releasees, and each of them, against any and all claims, disputes and/or controversies.  In the event of any such dispute concerning the Program or Services, I agree to the submission of the matter to Arbitration in accordance with the rules and regulations of the American Arbitration Association and that the same shall be conducted in the county of Marin, State of California.

11. I will not communicate the contents of My sessions, recordings, videos, or Program materials directly or indirectly with any other third parties, and understand that to do so would be a material violation of this Agreement which may result in termination of the Services and My participation in ALL the Programs without recourse.

12. I further agree that payment for the Program and Services with Provider shall be tendered prior to the commencement of the Program, that Provider or I may elect to cancel the Program in writing via email for reimbursement. After you have enrolled in the BTL mastery online program, you have 24 hours to cancel your enrollment in order to get a refund minus a $50.00 processing fee. After that, there are no refunds.

13. I agree that Provider is not responsible for any issues or damages caused by the use of the internet or any media provider used to facilitate the Services.

This Release, Waiver of Liability, Assumption of Risk and Indemnification Agreement is agreed to and given by Participant/Me to enable Me to feel free to participate in the Program(s), sessions and to the Services provided to help each other without fear of liability. This Release is given in consideration for similar releases granted or to be granted to My benefit. THIS RELEASE HAS NO EXPIRATION DATE AND SHALL BE DEEMED REAFFIRMED EACH TIME I PARTICIPATE IN THE PROGRAMS, ANY of the personal empowerment session or other Services with Devi’s Grace, LLC in any format or media.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS AND THAT IT IS A CONDITION OF MY PARTICIPATION IN THE PROGRAMS AND SESSIONS WITH PROVIDER, AND AGREE TO IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, AND INTEND TO BE BOUND THEREBY.  IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, SHALL CONTINUE IN FULL FORCE EFFECT.
